1. Who We Are and Scope

France Channel is a video-streaming and subscription service operated by France Channels SAS, a company organized under the laws of the French Republic (“France Channel,” “France Channels,” “we,” “us,” or “our”).

This US Privacy Policy explains how we collect, use, disclose, retain and protect personal information when you use France Channel websites, applications, software, video-streaming services, subscription services and related features in the United States (collectively, the “Services”), or communicate with customer service about the Services.

This Policy does not replace additional notices that may apply to a particular product, promotion, platform or jurisdiction. By using the Services, you acknowledge the practices described in this Policy. Questions may be sent to privacy.us@francechannel.tv.

2. Personal Information We Collect

Depending on how you use the Services, we may collect the following categories of personal information:

  • Identifiers and contact information, such as name, email address, account ID, postal or billing address, telephone number and similar identifiers.

  • Account and subscription information, such as plan, subscription status, start date, renewal date, cancellation date, account preferences and accepted subscription terms.

  • Payment and transaction information, such as payment-method type, transaction records, billing history, refunds, credits and limited payment identifiers. Full payment-card details may be processed directly by payment providers.

  • Age-related information, such as date of birth or an age or eligibility declaration where collected to apply the Services’ age requirement.

  • Device and technical information, such as IP address, browser type and version, operating system, device model, device identifiers, application version, network and connection information, diagnostic data and mobile advertising identifiers.

  • Usage and viewing information, such as pages visited, programs and channels viewed, viewing duration, searches, playback progress, playback settings, interactions, preferences and responses to features or offers.

  • Location information, including approximate location derived from an IP address and, where permitted and enabled, more precise network or device location information.

  • Communications and support information, such as messages sent to customer service, inquiries, complaints, survey responses, competition entries and other information you choose to provide.

  • Marketing and preference information, such as communication preferences, campaign interactions, content interests and responses to recommendations or special offers.

  • Social-media and sign-in information, such as public profile information or account information a social-media provider shares with us with your permission when you use that provider to register or sign in.

  • Information received from other third parties, such as app stores, payment providers, identity and fraud-prevention providers, analytics providers, advertising partners, content-distribution partners and social-media platforms.

  • Information from data suppliers, which may include demographic information, publicly available information, purchase data and advertiser data, where permitted by applicable law.

We may combine information collected from different sources and may create inferences about interests or preferences to personalize Content, recommendations and marketing, subject to applicable law and your privacy choices.

3. How We Use Personal Information

We may use personal information to:

  • Create, authenticate and administer accounts and subscriptions.

  • Provide, maintain, secure, troubleshoot and improve the Services and playback experience.

  • Process recurring subscription payments, taxes, refunds, credits, failed payments and payment-related support.

  • Send purchase confirmations, account notices, service messages, billing notices, renewal notices, annual notices, trial notices, price-change notices, cancellation confirmations, security alerts and other transactional or legally required communications.

  • Provide customer service and respond to questions, requests, complaints or closed-captioning concerns.

  • Personalize Content, recommendations, features and marketing based on viewing behavior, preferences and available demographic information.

  • Measure and analyze how the Services and campaigns are used, conduct surveys and research, test features and develop new products or functionality.

  • Prevent, detect and investigate fraud, payment fraud, abuse, copyright infringement, unauthorized access, security incidents and other unlawful activity.

  • Enforce our rights, protect Content and licensing restrictions, comply with the Terms and protect France Channel, users and third parties.

  • Comply with applicable laws, legal processes, regulatory requests and recordkeeping obligations.

  • Send marketing communications where permitted and consistent with your choices, administer promotions and manage email-suppression lists.

  • Create aggregated, de-identified or anonymized information for analytics, research, reporting and other lawful business purposes.

4. Subscription and Renewal Communications

If you have a subscription, we use account, contact, transaction and subscription information to administer the subscription and send transactional communications. These may include registration and purchase confirmations, payment-related messages, cancellation confirmations, renewal notices, annual notices, trial notices, price-change notices and other communications required by law.

We do not generally send a separate email before every unchanged monthly recurring charge. This does not affect our obligation to send an annual reminder or another renewal, trial, fee-change or legally required notice when applicable by law.

For California and qualifying Washington, D.C. subscribers, we may use your name, billing address, email address, plan, renewal period, billing frequency, amount, renewal or cancellation date and account status to generate and deliver the notices described in the US Terms and Conditions and required by applicable law.

Depending on the applicable law and the context, we may process personal information because it is necessary to provide a Service you requested, perform our agreement with you, comply with a legal obligation, prevent fraud or abuse, protect rights and safety, or pursue another lawful business purpose. Where consent is required, we will request it and honor applicable withdrawal or opt-out rights.

We seek to collect, use, retain and disclose personal information only to the extent reasonably necessary and proportionate for the disclosed purposes or for another compatible purpose permitted by law.

6. When We Disclose Personal Information

We may disclose personal information to the following categories of recipients:

  • Payment processors and payment-service providers, to process subscriptions, recurring payments, fraud checks, refunds and related support.

  • Hosting, cloud, security, communications, email, customer-support, analytics and technology providers that perform services on our behalf.

  • Content licensors, rights-management providers and distribution partners where reasonably necessary to deliver, authenticate and protect the Services and Content.

  • Advertising, analytics and social-media providers, subject to applicable law and your privacy choices.

  • Professional advisers, insurers, auditors, lenders and other business partners where reasonably necessary for legitimate business, compliance or risk-management purposes.

  • Government authorities, courts, law enforcement, regulators, internet-service providers or content-protection organizations when required or permitted by law, including to protect rights or investigate suspected unlawful activity.

  • A buyer, investor, lender, successor or other relevant party in connection with a merger, acquisition, financing, restructuring, bankruptcy or sale or transfer of all or part of our business or assets.

We require service providers that process personal information on our behalf to use appropriate contractual, organizational and technical safeguards and to process information only for authorized purposes. Payment partners may also use transaction data for fraud detection and prevention and are expected to maintain applicable payment-card security standards.

7. Sale, Sharing and Targeted Advertising

We do not sell personal information for money. Certain disclosures to advertising, analytics or social-media partners may nevertheless be considered a “sale,” “sharing,” “targeted advertising” or similar activity under the broad definitions used by some state privacy laws. For example, those partners may receive identifiers, device information, approximate location, browsing or viewing activity, campaign interactions or inferences to measure or personalize advertising.

Where applicable law gives you a right to opt out, we will provide an appropriate mechanism, which may include a privacy-choice tool, account setting, a “Do Not Sell or Share My Personal Information” link or recognition of a legally required universal opt-out signal such as Global Privacy Control.

We do not knowingly sell or share the personal information of consumers under 16 without any authorization required by applicable law.

8. Cookies and Similar Technologies

We and our service providers may use cookies, local storage, software development kits, pixels, tags, web beacons, device identifiers, HTTP referrers and similar technologies to:

  • Operate and secure the Services, keep you signed in and administer systems.

  • Remember preferences, playback settings and playback progress.

  • Analyze use of the Services, diagnose performance and improve features.

  • Measure email and online campaigns, personalize Content and, where permitted, support advertising and audience matching.

  • Understand traffic sources and interactions across websites, applications, devices and communications.

You can manage certain choices through any cookie or privacy-preference tool we provide and through browser or device settings. Some essential technologies are necessary for authentication, security, payment, playback or other core functionality and cannot be disabled through a preference tool. Disabling other technologies may reduce functionality or make some features unavailable.

We do not currently respond to general “Do Not Track” browser signals because there is no uniform industry standard. Where applicable law requires recognition of Global Privacy Control or another universal opt-out mechanism, we will honor the legally recognized signal as required.

9. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, maintain transaction and consent records, satisfy tax and accounting obligations, resolve disputes, enforce agreements, prevent fraud and comply with legal obligations. Retention periods vary by category, purpose and applicable law.

After cancellation, we may retain limited account, transaction, communication, consent or suppression records where necessary to demonstrate the subscription terms accepted, establish or defend legal claims, comply with law, prevent fraud or avoid sending marketing that you have declined. We may retain de-identified or anonymized information for longer where it cannot reasonably be linked back to you.

When personal information is no longer required, we will delete, de-identify, aggregate or securely dispose of it as appropriate.

10. Security

We use reasonable administrative, technical and organizational measures designed to protect personal information against unauthorized access, use, disclosure, alteration and destruction. These may include access controls, contractual safeguards, security monitoring and payment-industry controls used by our payment partners. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. International Processing

France Channel is operated from France and may use service providers in the United States, European Union, United Kingdom and other countries. Personal information may therefore be processed or stored outside the state or country where you live and may be subject to lawful access requests from governments, courts or law-enforcement authorities in those locations.

Where applicable law requires safeguards for an international transfer, we will use appropriate contractual, organizational or other legally recognized measures designed to provide the required level of protection.

12. Your US Privacy Rights

Depending on where you live and whether the applicable law covers France Channel or the relevant processing, you may have rights to:

  • Confirm whether we process your personal information and access categories or specific pieces of information.

  • Correct inaccurate personal information.

  • Delete personal information, subject to applicable exceptions.

  • Obtain a portable copy of certain personal information.

  • Opt out of sale, sharing, targeted advertising or certain profiling.

  • Limit certain uses or disclosures of sensitive personal information where the right applies.

  • Appeal a decision concerning a privacy request where applicable law provides an appeal right.

To submit a privacy request, email privacy.us@francechannel.tv and describe the request and the state in which you reside. We may need to verify your identity and, where permitted, the authority of an agent acting for you. We will respond within the period required by the law that applies to the request and will provide any applicable appeal or regulator information.

We will not discriminate against you for exercising an applicable privacy right, except as permitted by law. Certain information may be exempt from a request, including information needed to complete a transaction, provide the Services, protect security, prevent fraud, comply with law or establish or defend legal claims.

13. California Residents

To the extent the California Consumer Privacy Act, as amended (“CCPA”), applies, California residents may have rights concerning access, correction, deletion, portability, opting out of sale or sharing, limiting certain uses of sensitive personal information and non-discrimination.

Depending on how you use the Services, the categories of personal information we may have collected during the preceding 12 months include identifiers; customer records; commercial and subscription information; internet or other electronic-network activity; geolocation data; account-login information; inferences; and other information described in Section 2. We collect this information from you, your devices, service providers, platforms, social-media services, advertising or analytics partners and data suppliers. We use and disclose it for the purposes and to the recipients described in Sections 3 through 8.

Certain advertising or analytics disclosures may be treated as sale or sharing under the CCPA. California residents may use any “Do Not Sell or Share My Personal Information” mechanism we provide, an applicable privacy-choice tool or Global Privacy Control. We may verify access, correction or deletion requests as permitted by law, and authorized agents may submit requests where we can reasonably verify their authority.

California law may also permit a California resident to request information once per calendar year about personal information disclosed to third parties for their own direct-marketing purposes. A request may be sent to privacy.us@francechannel.tv with “California Direct Marketing Request” in the subject line.

14. Other State Privacy Laws

Residents of states with comprehensive privacy laws may have additional rights. Depending on the applicable state, these may include rights to access, correct, delete, obtain a portable copy, opt out of targeted advertising, sale or certain profiling, limit particular processing and appeal a decision. The scope, definitions and exemptions differ by state. We will apply the rights and exceptions required by the law applicable to your residence and may maintain state-specific supplements or procedures as laws change.

15. Children and Minors

The Services are not directed to children under 16, and a person under 16 may not register for a France Channel account or provide personal information to us. If we obtain actual knowledge that an account was created by a child under 16 in violation of the US Terms and Conditions, we will take appropriate steps to close the account and delete associated personal information, subject to any legal obligation to retain limited records.

A user who is at least 16 but under the age of legal majority may use the Services only with the involvement and approval of a parent or guardian. Nothing in this section limits privacy rights that apply to minors under state law. We do not knowingly sell or share personal information of consumers under 16 without any legally required authorization.

16. Marketing Communications

You may opt out of promotional email marketing at any time by using the unsubscribe link in a marketing message or changing available account preferences. We may keep a limited suppression record so that we can honor the request. Transactional, account-security, billing, renewal, cancellation and legally required messages are not marketing communications and may continue while necessary to administer the account or comply with law.

We may measure email-campaign performance using pixels or similar technology. Depending on your email provider, you may be able to limit this measurement by blocking remote images.

17. Third-Party Services

The Services may contain links to or integrations with third-party websites, platforms, app stores, payment services, social networks, analytics providers or advertising services. Their privacy practices are governed by their own notices. We are not responsible for third-party privacy practices except as required by applicable law.

18. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in law, technology, the Services or our business practices. We will post the updated version and, where required by law, provide additional notice or obtain consent. The effective or version date will appear at the beginning of the Policy.

France Channel is a video-streaming and subscription service operated by France Channels SAS, a company organised under the laws of the French Republic ("France Channel", "France Channels", "we", "us" or "our"). France Channels SAS is the controller of the personal data described in this Policy.

France Channels SAS is established at 8 Avenue Raphaël, 75016 Paris, France. France Channel is not established in the United Kingdom and does not maintain a UK branch, office or customer-service representative. All privacy communications with France Channel must be made by email as described in Section 19.

This UK Privacy Policy provides information under the UK GDPR and the Data Protection Act 2018 and explains how we collect, use, disclose, retain and protect personal data when you use France Channel websites, applications, software, video-streaming services, subscription services and related features in the United Kingdom (collectively, the "Services"), or communicate with us about the Services.

This Policy should be read with the UK Terms and Conditions and any additional notice presented for a specific feature or third-party platform.   • Checkout and consent records, such as the date and time, wording and version of your automatic-renewal acknowledgement, your selection of immediate access or a 14-day delayed start, your express request for immediate digital-content supply and your acknowledgement concerning loss of the statutory cancellation right.

  • Payment and transaction information, such as payment-method type, limited payment identifiers, transaction records, billing history, refunds, credits and failed-payment information. Full payment-card details may be processed directly by payment providers.

  • Device and technical information, such as IP address, browser type and version, operating system, device model, device identifiers, application version, network and connection information and diagnostic data.

  • Usage and viewing information, such as pages visited, programmes and channels viewed, viewing duration, searches, playback progress, playback settings, watchlists, interactions and content preferences.

  • Approximate location information derived from your IP address or device settings, used to determine whether Content may be supplied in the authorised territory. We do not need precise GPS location for the ordinary Services described in this Policy.

  • Communications and support information, such as emails, enquiries, complaints, feedback, subtitle or accessibility reports and survey or research responses you choose to provide.

  • Communication preferences, such as whether you have chosen to receive optional France Channel promotional emails and records needed to honour an unsubscribe request.

  • Third-party platform and sign-in information, such as information supplied by an app store, payment provider, distribution partner or social sign-in provider where you use that service to register, pay or access France Channel.

We may combine data collected from these sources and may infer Content interests or preferences from viewing activity to provide recommendations and improve the Services. France Channel does not use personal data to place advertising in the Services.

3. How We Collect Personal Data

We collect personal data directly from you when you register, subscribe, choose a trial-start option, make a payment, change settings, cancel, exercise a right, contact support, participate in a survey or otherwise communicate with us.

We collect technical, usage, viewing and approximate-location data automatically from your browser, application, device or network when you use the Services, including through cookies and similar technologies described in Section 8.

We may receive data from payment providers, app stores, distribution platforms, identity and fraud-prevention providers, hosting and technology suppliers, social sign-in providers and other service providers involved in delivering the Services. A third party that controls its own service processes data under its own privacy notice.

4. Why We Use Personal Data and Our Lawful Bases

UK data-protection law requires France Channel to have a lawful basis for each use of personal data. More than one basis may apply where the purposes are genuinely distinct. The table below describes the main purposes, data and lawful bases for the Services covered by this Policy.

Where France Channel relies on legitimate interests, those interests include operating and improving an advertising-free streaming service, protecting accounts and licensed Content, preventing fraud, understanding service performance and managing legal claims. We assess whether those interests are outweighed by your rights and expectations. You may object as described in Section 13.

5. Subscription and Renewal Records and Communications

France Channel uses account, contact, transaction and subscription data to administer recurring subscriptions and to send transactional communications. These may include registration and purchase confirmations, payment-related messages, trial and first-charge information, statutory cancellation information, annual-renewal reminders, price-change notices, cancellation confirmations and security messages.

For a direct annual subscription, France Channel uses your email address, plan, renewal date, price and account status to send the annual renewal reminder 30 days before the scheduled automatic-renewal payment. France Channel does not generally send a separate email before every unchanged monthly recurring charge.

We retain records of the checkout wording, version, date and time; your age information; your automatic-renewal acknowledgement; your selection of immediate access or a 14-day delayed start; and any express consent and acknowledgement concerning supply of digital content. We use those records to perform the contract, administer your rights and demonstrate the terms accepted.

6. When We Share Personal Data

France Channel shares personal data only where reasonably necessary for the purposes described in this Policy, including with the following categories of recipient:

  • Payment processors and payment-service providers, to process subscriptions, recurring payments, fraud checks, refunds and related support. Payment providers may act as independent controllers for some payment processing.

  • Hosting, cloud, content-delivery, security, communications, email, customer-support, analytics and technology providers that perform services for France Channel.

  • Content licensors, rights-management providers and distribution partners where reasonably necessary to deliver, authenticate and protect the Services and Content.

  • App stores, device platforms and other third-party subscription platforms where you purchase or access France Channel through them.

  • Professional advisers, insurers, auditors, lenders and other business partners where reasonably necessary for legal, compliance, accounting or risk-management purposes.

  • Government authorities, courts, law-enforcement bodies, regulators, internet-service providers or content-protection organisations when required or permitted by law, including to protect rights or investigate suspected unlawful activity.

  • A buyer, investor, lender, successor or other relevant party in connection with a merger, acquisition, financing, restructuring, insolvency or sale or transfer of all or part of France Channel's business or assets.

Service providers acting on France Channel's behalf are required to use appropriate contractual, organisational and technical safeguards and to process personal data only for authorised purposes. France Channel seeks to disclose only the data reasonably needed for the recipient's role.

7. No Advertising or Sale of Personal Data

France Channel does not provide advertising in the Services. We do not use viewing data to serve third-party advertisements, and we do not disclose personal data to advertisers for targeted advertising.

France Channel does not sell personal data for money. We may use service providers to send France Channel's own transactional or optional promotional communications, but they may use the data only to provide that service to France Channel.

8. Cookies and Similar Technologies

France Channel and its service providers may use cookies, local storage, software development kits, pixels, tags, web beacons, device identifiers and similar technologies for the following purposes:

  • Operate and secure the Services, authenticate users, administer subscriptions and payments, and enforce territorial or Content rights.

  • Remember preferences, playback settings, watchlists and playback progress.

  • Diagnose performance, understand how the Services are used, test features and improve functionality.

  • Measure whether France Channel transactional or optional promotional emails are delivered or interacted with, where permitted by law.

Strictly necessary technologies may be used without consent where the law permits because the Services cannot work properly without them. Non-essential analytics, performance or email-measurement technologies will be used only after consent where consent is required, or under another applicable legal exemption.

France Channel does not use advertising or targeted-advertising cookies in the Services. You can manage non-essential choices through any cookie-preference tool we provide and through browser or device settings. Disabling necessary technologies may prevent authentication, payment, playback or other core functionality.

9. How Long We Keep Personal Data

France Channel keeps personal data for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, maintain transaction and consent records, satisfy tax and accounting obligations, resolve disputes, enforce agreements, prevent fraud and comply with legal obligations. Retention periods vary by category, purpose and applicable law.

After cancellation, we may retain limited account, transaction, communication, consent, withdrawal or suppression records where necessary to demonstrate the subscription terms accepted, establish or defend legal claims, comply with law, prevent fraud or avoid sending promotional communications that you declined.

When personal data is no longer required, we will delete, anonymise, aggregate or securely dispose of it as appropriate. We may retain irreversibly anonymised information for longer because it can no longer reasonably identify you.

10. Security

France Channel uses appropriate administrative, technical and organisational measures designed to protect personal data against unauthorised access, use, disclosure, alteration, loss and destruction. No method of transmission or storage is completely secure. You should use a strong password, keep it confidential, log out on shared devices and contact support.uk@francechannel.tv promptly if you suspect unauthorised account use.

11. International Processing and Transfers

France Channel is operated from France and may use service providers in the United Kingdom, European Economic Area, United States and other countries. Personal data may therefore be processed or stored outside the United Kingdom and may be subject to lawful access requests from authorities in those locations.

Where UK data-protection law requires a safeguard for an international transfer, France Channel will rely on an applicable UK adequacy regulation, the UK International Data Transfer Agreement, the UK Addendum to approved standard contractual clauses, another legally recognised safeguard or a permitted exception. We may apply additional technical and organisational protections where appropriate.

12. Children and Young People

The Services are not directed to children under 16, and a person under 16 may not register for an account or provide personal data to France Channel. If we obtain actual knowledge that an account was created by a child under 16 in breach of the UK Terms and Conditions, we will take appropriate steps to close the account and delete associated personal data, subject to any legal obligation to retain limited records.

A user who is at least 16 but under 18 may use the Services only with the involvement and approval of a parent or legal guardian. France Channel does not currently provide children's profiles or parental controls within the Services.

13. Your UK Data-Protection Rights

Subject to the conditions and exceptions in UK data-protection law, you may have the right to:

  • Be informed about how France Channel uses your personal data.

  • Request access to personal data France Channel holds about you.

  • Ask France Channel to correct inaccurate or incomplete personal data.

  • Ask France Channel to erase personal data in circumstances where the right applies.

  • Ask France Channel to restrict processing in circumstances where the right applies.

  • Object to processing based on legitimate interests and object at any time to direct marketing.

  • Receive certain personal data you provided in a structured, commonly used and machine-readable format and, where technically feasible, have it transmitted to another controller.

  • Withdraw consent at any time where processing is based on consent, without affecting processing carried out before withdrawal.

  • Not be subject to a decision based solely on automated processing that produces legal or similarly significant effects, subject to legal exceptions.

To exercise a right, email privacy.uk@francechannel.tv and describe your request. We may ask for information reasonably necessary to verify your identity or the authority of a person acting for you. We will normally respond within one month, although the law permits an extension for a complex or multiple request. We will explain any applicable extension, refusal or exemption.

These rights are not absolute. France Channel may retain or continue using information where necessary to provide the Services, protect security, prevent fraud, comply with law, protect another person's rights or establish, exercise or defend legal claims.

14. Data You Must Provide and Consequences

France Channel needs certain identifiers, contact details, age information, account details and subscription/payment information to create an account, establish the contract, provide the Services and process recurring charges. If you do not provide required information, France Channel may be unable to create the account, activate the subscription, verify a cancellation request or provide the relevant support.

Optional survey responses, feedback and promotional-email choices are voluntary. Refusing optional data does not prevent you from using the paid streaming service, although a feature that depends on that data may not be available.

15. Automated Decision-Making and Recommendations

France Channel may use viewing and usage data to generate automated Content recommendations, resume-watching features or popularity rankings. These features do not produce legal effects or similarly significant effects on you.

France Channel does not use solely automated decision-making covered by the UK GDPR to make decisions that have a legal or similarly significant effect on you. If this changes, we will update this Policy and provide any information and safeguards required by law before the processing begins.

16. Optional Promotional Communications

France Channel may send promotional emails about France Channel Content or Services where you have consented. You may withdraw consent at any time by using the unsubscribe link in a promotional email or by emailing privacy.uk@francechannel.tv. We may retain a limited suppression record to honour the request.

Transactional, account-security, billing, annual-renewal, price-change, cancellation and legally required messages are not promotional communications and may continue while necessary to administer the account or comply with law.

17. Third-Party Services

The Services may contain links to or integrations with third-party websites, app stores, device platforms, payment services, social sign-in services or other platforms. Their privacy practices are governed by their own notices. France Channel is not responsible for third-party privacy practices except as required by applicable law.

If a third party is the merchant of record for your subscription, it may independently determine how it processes payment, billing, renewal and cancellation data. You should read its privacy notice and account settings.

18. Changes to This Privacy Policy

France Channel may update this Privacy Policy from time to time to reflect changes in law, technology, the Services or business practices. We will post the updated version and, where required by law, provide additional notice or obtain consent. The version date will appear at the beginning of the Policy.

If a change materially affects how France Channel uses personal data, we will provide advance notice where required and bring the new use to your attention before it begins.
