1. About These Terms
These Terms and Conditions (the “Terms”) govern your access to and
use of websites, applications, mobile applications, software, products,
video-streaming services, subscription services and related features
owned and/or operated by France Channels SAS, a company organized under
the laws of the French Republic (“France Channel,” “France Channels,”
“we,” “us,” or “our”) (collectively, the “Services”).
These Terms apply to consumers accessing or purchasing the Services
in the United States, whether directly through France Channel or through
a third-party platform, and whether using a computer, mobile device,
connected television, streaming device, gaming console or other
compatible equipment. The Services may be accessed only from devices
located in the United States unless we expressly state otherwise.
If you access or purchase the Services through a third-party
platform, app store or distribution partner, that third party’s terms
may also apply to the purchase, payment, renewal or cancellation. Where
a third party controls billing, you may need to manage or cancel the
subscription through that third party.
By registering for an account, purchasing a subscription or using the
Services, you acknowledge that you have read and agree to these Terms
and our US Privacy Policy. If you do not agree, do not register for,
purchase or use the Services.
2. Eligibility and Age
Requirement
The Services are not directed to children under 16. A person under 16
may not register for an account, purchase a subscription or provide
personal information to France Channel.
If you are at least 16 but under 18, or otherwise under the age of
legal majority where you live, you may use the Services only with the
involvement and approval of a parent or legal guardian who agrees to
these Terms. Parents and guardians are responsible for deciding whether
Content is appropriate for members of their household. France Channel
does not currently provide parental controls within the Services.
The age requirement is a contractual eligibility condition. It is not
a promise that we will verify every user’s age through government
identification or another formal age-verification process. We may
suspend or terminate an account if we reasonably believe that it was
created or used in violation of this section.
3. Account Registration and
Security
To use certain Services, including a paid subscription, you may be
required to create an account and provide accurate, current information,
including your name, email address, billing address and payment
information. You must keep that information current and may not use
false information or another person’s information without
authorization.
You are responsible for maintaining the confidentiality and security
of your login credentials and for activity conducted through your
account to the extent permitted by law. You must promptly notify us at
support.us@francechannel.tv
if you become aware of unauthorized use of your account or
credentials.
You are responsible for ensuring that members of your household who
use your account comply with these Terms. We may suspend or terminate
access if account information is materially inaccurate, the account is
used without authorization, or the account is used in a manner that
violates these Terms or applicable law.
4.
Subscription Plans, Content and Service Availability
France Channel may offer monthly, annual, promotional, introductory,
trial, advertising-supported or other plans. The specific plan, price,
billing frequency, initial term, renewal term, included features and
material limitations will be displayed before you complete a purchase
and may also be available in your Account Details.
Content, channels, programs, subtitles, closed captions, availability
windows, device compatibility, simultaneous-stream limits, video quality
and other Service characteristics may vary by plan, territory, device
and licensing arrangement. We may add, remove or replace Content from
time to time. Unless expressly stated in a subscription offer, we do not
guarantee that a particular title, channel or program will remain
available for a particular period.
The quality of streamed Content may vary based on your device,
location, internet connection, bandwidth and other technical factors.
Not all Content is available in high definition. You are responsible for
internet, mobile-data and equipment charges associated with your use of
the Services.
5.
Subscription Price, Recurring Charges and Automatic Renewal
Your paid subscription is a recurring subscription. Before you
complete an online purchase, the checkout flow will clearly display the
subscription price, billing frequency, initial and renewal terms, the
fact that the subscription automatically renews unless canceled, the
recurring charge or range of charges, and the method by which you can
cancel.
By selecting the registration or subscription button, checking the
applicable consent box and completing the purchase, you expressly
consent to the automatic-renewal terms and recurring payments. You
authorize France Channel and its payment processor to charge your
selected payment method for the subscription price and applicable taxes
on each billing date until the subscription is canceled or
terminated.
The checkout presentation in effect when you purchase controls the
price, billing frequency and plan terms accepted by you. If a trial,
introductory or promotional price applies, the checkout flow will state
the duration of that period, the price that will apply afterward and the
timing of the first regular recurring charge. We will provide a purchase
or subscription acknowledgment that you can retain and that includes the
applicable renewal terms, cancellation policy and cancellation
method.
We do not generally send a separate email before every unchanged
monthly recurring charge. Your Account Details will display your
subscription status and, where supported, the current price and next
billing date. This does not limit our obligation to send annual,
renewal, trial, price-change or other notices required by applicable
law.
Your purchase may be subject to sales, use, value-added or other
taxes, duties or charges. Any applicable tax will be included in the
price or shown during the purchase process as required. Subscription
pricing does not include internet-access or data charges.
You authorize us and our payment processors to charge the payment
method you provide for all amounts properly due under your subscription.
You are responsible for keeping your payment and contact information
current. A payment processor may place a temporary test authorization on
your payment method without completing a charge.
If a payment fails because the payment method has expired, has
insufficient funds, has been deactivated or is otherwise unavailable, we
may retry the payment, request updated information or use updated
payment information made available by the payment-method provider,
subject to applicable law and provider rules. We may suspend access
while an amount remains unpaid, and you remain responsible for amounts
properly due.
Your payment-method provider may impose foreign-transaction,
currency-conversion, overdraft or other fees. Those fees are charged by
the provider and are your responsibility.
7. Cancellation
You may cancel a direct France Channel subscription at any time by
signing in at www.francechannel.tv, opening your Account Details or
Settings and selecting the subscription cancellation option. The online
cancellation path is intended to provide a simple, direct method to stop
future automatic renewals. We will not require you to explain why you
are canceling, and we will not obstruct or unreasonably delay completion
of the cancellation.
We may require you to authenticate your account before canceling.
Where applicable law requires cancellation through the same medium used
to subscribe, or another medium in which you normally interact with us,
we will provide that cancellation method. If you subscribed through a
third-party platform, you may need to cancel through that platform’s
account or subscription settings.
Cancellation stops future automatic renewals when it is processed.
Unless applicable law or your subscription offer provides otherwise,
cancellation takes effect at the end of the current paid billing period,
and you may continue to access the Services through that date. You must
cancel before the next renewal is processed to avoid the next recurring
charge. We will provide a cancellation confirmation where required by
law or supported by the applicable platform.
Nothing in these Terms limits a non-waivable cancellation, refund,
chargeback or other consumer right provided by applicable law.
8. Renewal, Trial and Annual
Notices
France Channel will provide renewal, annual, trial and other
subscription notices when required by applicable law. These notices
supplement the information presented at registration, in the
subscription acknowledgment and in your Account Details.
8.1 California subscribers

Annual reminder. For an automatic-renewal or continuous-service
subscription subject to California law, we will send a reminder at least
annually using the same medium that resulted in activation or a medium
in which you ordinarily interact with us. The reminder will identify the
Service, the frequency and amount of the recurring charges, and how to
cancel.

Initial term of one year or longer. If the subscription has an
initial term of one year or longer and automatically renews unless
canceled, we will provide the required advance-renewal notice at least
15 days and no more than 45 days before renewal.

Electronic notice and cancellation. Where required, an electronic
notice will include a link or another reasonably accessible electronic
method that directs you to the cancellation process.
8.2 Washington, D.C.

A subscription with an initial term of 12 months or more that
automatically renews for a term of one month or more will receive notice
of the first automatic renewal and annually thereafter. The notice will
be sent no fewer than 30 days and no more than 60 days before the
applicable cancellation deadline.

The notice will state that the subscription will renew unless
canceled, the cost for the renewal term, the cancellation deadline and
the methods for obtaining the renewal and cancellation details. If the
notice is sent by email, it will include an active link that allows
cancellation.
The timing and content above apply only where the stated state law
covers the particular subscription and transaction. We do not generally
send a separate notice before every unchanged monthly charge.
9. Price and Material Term
Changes
We may change subscription prices or other plan terms prospectively,
subject to applicable law. If a change affects an existing recurring
subscription, we will provide advance notice where required and will
state the new price or material term, the effective date and how to
cancel before the change applies. We will obtain additional consent if
applicable law requires it.
For a California subscription subject to the California fee-change
rule, we will provide a clear notice of the fee change and cancellation
information no fewer than 7 days and no more than 30 days before the new
fee takes effect.
10. Refunds and Credits
Except where required by applicable law or expressly promised in the
subscription offer, payments are non-refundable and we do not provide
credits for partially used billing periods. Following cancellation, you
will generally retain access through the end of the paid period. This
policy does not limit rights that cannot lawfully be waived, including
rights under applicable consumer-protection laws or payment-network
rules.
11. Electronic
Communications and Marketing
By creating an account or purchasing a subscription, you consent to
receive electronic communications concerning the account and Services,
including purchase confirmations, service messages, security messages,
payment notices, renewal notices, price-change notices, cancellation
confirmations and other transactional or legally required
communications.
We may provide notices by email, in-account message, application
notification or another electronic method permitted by law. Where a law
requires a particular method, timing, content or active cancellation
link, we will follow that requirement. You are responsible for
maintaining a current email address and reviewing account
communications.
You may opt out of promotional marketing by using the unsubscribe
mechanism in a marketing message or changing available account
preferences. You cannot opt out of transactional, account-security,
billing, renewal, cancellation or legally required messages while the
relevant account or subscription remains active.
12. Intellectual
Property and Permitted Use
France Channel, its affiliates and its licensors own or control the
Services and Content, including video, audio, text, graphics,
photographs, designs, software, trademarks, trade names, logos and other
materials. Subject to these Terms, we grant you a limited,
non-exclusive, non-transferable, revocable right to access and view
Content for personal, non-commercial use during an active subscription
or other authorized access period.

Do not copy, download except where the Services expressly permit
it, reproduce, republish, upload, transmit, distribute, sell, rent,
license, publicly display or perform, edit, store, adapt or create
derivative works from the Services or Content.

Do not circumvent or remove digital-rights management,
geo-blocking, access controls, content protection or other technical
restrictions.

Do not reverse engineer, decompile, disassemble or modify
software, or use automated tools to scrape or systematically extract
Content or Service data, except to the extent applicable law prohibits
us from restricting that activity.

Do not interfere with the operation, security, availability or
integrity of the Services, introduce malicious code, manipulate
identifiers, impersonate another person or use the Services for
unlawful, abusive or fraudulent activity.

Do not use France Channel names, marks, logos or Content in a
manner that suggests sponsorship, endorsement or affiliation without
prior written permission.
No license or right is granted except as expressly stated in these
Terms. France Channel and its licensors reserve all rights not expressly
granted.
13. Account
Sharing, Devices and Geographic Restrictions
A subscription is for personal, non-commercial use unless the
applicable plan expressly states otherwise. You may not share the
account outside the household or otherwise make the subscription
available to unauthorized persons. We may limit the number of registered
devices and simultaneous streams, and those limits may vary by plan or
platform.
You may not bypass subscription, registration, geo-fencing or other
access requirements, or assist another person to do so. Access from
outside the authorized territory may be blocked.
14. Software and Updates
France Channel may provide software or application updates
automatically. If you decline or fail to install an update, some
Services may not function. You are responsible for device compatibility
and for maintaining an internet connection and supported operating
environment.
Software may collect limited device and Service-use information
needed to authenticate access, manage Content rights, provide playback,
diagnose problems, enforce these Terms and improve the Services, as
described in the US Privacy Policy. When your right to use the software
ends, you must stop using it and delete copies where applicable.
15. Interactive Areas
and User Submissions
France Channel may make chats, discussion boards, user-content areas
or similar interactive features available. You must be at least 18, or
the age of legal majority where you live, to post in a public
interactive area. Information posted there may be public and should not
include personal contact, financial or other sensitive information about
you or another person.
You are responsible for material submitted through your account and
represent that you have the rights needed to submit it. You grant France
Channel a non-exclusive, worldwide, royalty-free license to host,
reproduce, display, modify and distribute that material only as
reasonably necessary to operate, promote and improve the relevant
interactive feature, subject to applicable law and our Privacy
Policy.
Do not submit unlawful, harmful, threatening, abusive, harassing,
defamatory, obscene, hateful, infringing, deceptive,
commercial-solicitation or malicious material. We may moderate, remove
or restrict content or access where reasonably necessary, but we are not
required to pre-screen every submission.
France Channel does not accept unsolicited creative submissions,
including program concepts, stories, scripts, character ideas or
designs. Please do not send them. If you nevertheless submit unsolicited
material, it will not be treated as confidential and France Channel will
have no obligation to review, return or compensate you for it, to the
extent permitted by law.
The Services may contain links to or integrations with third-party
websites, platforms, payment services, app stores, social networks or
advertising services. Their terms and privacy practices apply to their
services. A link or integration does not constitute an endorsement, and
France Channel is not responsible for third-party content, practices,
availability or transactions except as required by law.
If you acquire an application through the Apple App Store, Samsung
Galaxy Store or another app marketplace, the agreement concerning France
Channel is between you and France Channels SAS, not the marketplace
operator. France Channel, not the marketplace, is responsible for the
Services and support described in these Terms. The marketplace and its
affiliates may be third-party beneficiaries of these Terms to the extent
required by the marketplace rules, and the marketplace may control
billing, renewal and cancellation for purchases made through it.
17. Changes to the
Services and These Terms
We may update the Services, Content, features and these Terms from
time to time. Changes will take effect when posted or on a later date
stated in a notice. If a change materially affects your rights or
obligations, we will provide notice and obtain consent where required by
applicable law.
Nothing in this section allows us to change an existing paid
subscription price or another material subscription term without any
notice or consent required by law. If you do not agree to revised Terms,
you must stop using the affected Services and may cancel the
subscription before the change takes effect.
18. Suspension and Termination
We may suspend or terminate access where reasonably necessary to
protect the Services or Content, prevent fraud or unauthorized use,
address non-payment, comply with law, enforce these Terms or protect
France Channel, its licensors, users or third parties. Where required by
law, we will provide applicable notice, continued access, refund or
another remedy.
On termination, your license to use the affected Services and Content
ends. Provisions that by their nature should survive termination,
including provisions concerning ownership, restrictions, liability,
indemnification, dispute resolution and accrued payment obligations,
will survive.
19. Disclaimers and
Limitation of Liability
To the maximum extent permitted by applicable law, the Services and
Content are provided on an “as available” basis. We do not guarantee
uninterrupted or error-free operation, a particular streaming quality,
the continued availability of particular Content, or that all
information is complete, current or free from harmful components. The
Services and Content may contain facts, views and opinions from France
Channel or third parties and are not a substitute for medical, legal,
financial or other professional advice.
To the maximum extent permitted by law, France Channel disclaims
implied warranties, including warranties of merchantability, fitness for
a particular purpose and non-infringement. Nothing in these Terms
excludes or limits a warranty, liability or consumer right that cannot
lawfully be excluded or limited.
To the maximum extent permitted by law, France Channel and its
affiliates, licensors, officers, employees and agents will not be liable
for indirect, incidental, special, consequential or punitive damages
arising from the Services, Content or these Terms. Any limitation
applies only to the extent permitted by applicable law and does not
apply to liability that cannot legally be limited.
20. Indemnification
To the extent permitted by applicable law, you agree to indemnify and
hold harmless France Channel, its affiliates, officers, employees,
licensors and agents from claims, losses, expenses, damages and
reasonable legal fees arising from your material breach of these Terms,
unlawful or unauthorized use of the Services, content you submit, or
infringement of third-party rights caused by your conduct.
21. Closed Captioning
Questions, concerns or complaints about closed captioning may be sent
to support.us@francechannel.tv
or to the mailing address in Section 24. Please include the title of the
program, the device or platform used, the date and approximate time of
the issue, and a description of the problem so we can investigate.
22. Governing Law and
Dispute Resolution
These Terms are governed by the laws of the French Republic, without
regard to conflict-of-law principles, except that mandatory U.S. federal
law and mandatory consumer-protection laws of the state in which you
reside apply to the extent required.
Before starting a formal proceeding, you and France Channel should
attempt in good faith to resolve the matter by contacting support.us@francechannel.tv.
A dispute that is not resolved informally may be brought in a court
having jurisdiction under applicable law. Nothing in these Terms
prevents France Channel from seeking injunctive or other equitable
relief to protect intellectual-property rights, Content rights, security
or unauthorized access.
23. Export Controls and
Sanctions
You must comply with applicable export-control, trade-sanctions and
similar laws when accessing or using the Services, software or related
technical data. You may not use or make the Services available in a
manner prohibited by applicable law.

If you subscribed directly online, you can cancel through your
Account Details or Settings without contacting customer service. If you
subscribed through a third-party platform, use that platform’s
cancellation process.
25. Entire Agreement,
Severability and Waiver
These Terms, the US Privacy Policy and any subscription-specific
terms presented at checkout form the agreement between you and France
Channel concerning the Services. If a provision is held invalid or
unenforceable, it will be modified or severed only to the extent
necessary, and the remaining provisions will remain in effect.
A failure to enforce a provision is not a waiver of that provision or
any other provision. Except where these Terms expressly provide
otherwise, there are no third-party beneficiaries other than an
applicable app marketplace to the extent stated in Section 16.

France. France Channel is not established in the United Kingdom and does
not maintain a UK branch, office or customer-service representative. All

These Terms apply to consumers accessing or purchasing the Services
in England, Wales, Scotland or Northern Ireland, whether directly
through France Channel or through a third-party platform, and whether
using a computer, mobile device, connected television, streaming device,
gaming console or other compatible equipment. Unless we expressly state
otherwise, the Services may be accessed only from devices located in the
United Kingdom.
If you access or purchase the Services through a third-party
platform, app store or distribution partner, that third party's terms
may also apply to the purchase, payment, trial, renewal, cancellation or
refund. Where a third party controls billing, you may need to manage or
cancel the subscription through that third party.
By registering for an account, purchasing a subscription or using the
Services, you agree to these Terms and acknowledge our UK Privacy
Policy. If you do not agree, do not register for, purchase or use the
Services.

address, date of birth, billing address and payment information. You
must keep this information up to date and must not use false information
or another person's information without authorisation.
You are responsible for maintaining the confidentiality and security
of your login credentials and for activity conducted through your
account to the extent permitted by law. If you become aware of
unauthorised use of your account or credentials, email support.uk@francechannel.tv
promptly.
You are responsible for ensuring that members of your household who
use your account comply with these Terms. We may require reasonable
authentication before making account, payment or cancellation
changes.
4. The Service, Content
and Availability
France Channel provides a paid, advertising-free video-streaming
service. The Services do not contain advertising breaks or third-party
advertising.
France Channel may offer monthly, annual, promotional, introductory
or trial plans. The specific plan, price, billing frequency, initial
term, renewal term, included features and material limitations will be
displayed before you complete a purchase and may also be available in
your Account Details.
Content, channels, programmes, subtitles, availability windows,
device compatibility, simultaneous-stream limits, video quality and
other Service characteristics may vary by plan, territory, device and
licensing arrangement. We may add, remove or replace Content from time
to time. Unless a subscription offer expressly says otherwise, we do not
guarantee that a particular title, channel or programme will remain
available for a particular period.
Streaming quality may vary based on your device, location, internet
connection, bandwidth and other technical factors. Not all Content is
available in high definition. You are responsible for internet-access,
mobile-data and equipment charges associated with your use of the
Services.
5. Subscription
Plans, Price and Automatic Renewal
A France Channel paid subscription is a recurring subscription.
Before you complete a direct online purchase, the checkout flow will
clearly display the subscription price, billing frequency, free-trial
period, initial and renewal terms, the fact that the subscription
automatically renews unless cancelled, the recurring charge, the first
expected charge date and how to cancel.
The checkout presentation in effect when you subscribe controls the
price, billing frequency and plan terms accepted by you. Prices shown to
UK consumers will be in pounds sterling and will include VAT where
applicable.
You must actively tick a separate, unticked box confirming that you
understand the subscription is recurring, automatically renews, and
authorises France Channel and its payment processor to charge your
selected payment method on each billing date until the subscription is
cancelled or terminated. The final order button will make clear that
completing the order creates an obligation to pay after the free
trial.
For a direct France Channel subscription that includes a seven-day
free trial, you must choose one of the following mutually exclusive
options at checkout. The wording to be used is set out in Appendix
B.
If you select the immediate-start option, you expressly request
France Channel to begin supplying the digital content during the
statutory 14-day cancellation period. Your seven-day free trial begins
immediately. You also acknowledge that you lose the statutory 14-day
right to cancel once France Channel begins supplying the digital content
to your account.
Even after the statutory right has been lost, you retain the separate
contractual right to cancel the recurring subscription. If you cancel
before the seven-day free trial ends, France Channel will not take the
first subscription payment. Access may continue until the end of the
free trial unless the checkout offer states otherwise.
6.2 Wait 14
days before the seven-day free trial begins
If you select the delayed-start option, France Channel will not
activate access to the subscription Content during the 14-day statutory
cancellation period. You may cancel the contract during that period
without giving a reason and without a subscription charge.
If you do not exercise the statutory cancellation right, the
seven-day free trial begins automatically after the 14-day period ends.
The first recurring monthly or annual payment will be taken after the
seven-day free trial ends, unless you cancel before that charge is
processed.
7. Contract Confirmation
After a direct subscription is completed, France Channel will send a
confirmation to the email address registered to your account in a form
you can keep. The confirmation will include a copy of these Terms,
attach them, or otherwise provide them in a durable form that you can
store and reproduce unchanged. It will record the plan, price, billing
frequency, free-trial period, selected start option, first expected
charge date, automatic-renewal terms, cancellation method and statutory
cancellation information. Where required, it will also confirm your
express request and acknowledgement concerning immediate supply of
digital content.
You are responsible for providing and maintaining a current email
address and for retaining the confirmation. If you do not receive it,
check your spam or junk folder and email support.uk@francechannel.tv.
8. Payment, Billing,
VAT and Failed Payments
You authorise France Channel and its payment processors to charge the
payment method you provide for all amounts properly due under your
subscription. Full payment-card details may be stored and processed
directly by a payment provider. You are responsible for keeping payment
and contact information current.
After any free trial, recurring payments will, where possible, be
charged on the same numerical date each month or year as the first paid
billing date. If that date does not occur in a particular month, the
charge may be made on the last day of that month. For an annual
subscription beginning on 29 February, a non-leap-year renewal may be
processed on 28 February.
If a payment fails because the payment method has expired, has
insufficient funds, has been deactivated or is otherwise unavailable, we
may retry the payment, request updated information or use updated
payment information made available by the payment-method provider,
subject to applicable law and provider rules. We may suspend access
while an amount properly due remains unpaid.
Your payment-method provider may impose foreign-transaction,
currency-conversion, overdraft or other fees. Those fees are charged by
the provider and are your responsibility.
9. Statutory 14-Day
Right to Cancel (Withdrawal)
For a direct online subscription, UK consumer law generally gives you
14 days from the day after the contract is made to cancel without giving
a reason. This statutory right is separate from the ongoing right to
stop future automatic renewals under Section 10.
If you choose the delayed-start option in Section 6.2, no
subscription Content will be supplied during the 14-day period. You may
exercise the right by emailing support.uk@francechannel.tv
with a clear statement that you are cancelling, or by using the model
form in Appendix A. France Channel will acknowledge the cancellation by

If you choose the immediate-start option in Section 6.1, you
expressly consent to supply of digital content during the cancellation
period and acknowledge that the statutory right is lost once supply
begins. France Channel will not rely on loss of that right unless the
required express consent and acknowledgement were obtained and
confirmed.
Where a valid statutory cancellation is exercised and a payment has
been taken, France Channel will reimburse the amount due without undue
delay and no later than 14 days after being informed of the
cancellation, using the same payment method unless you agree otherwise.
Nothing in this section limits a statutory right that cannot lawfully be
excluded.
10. Cancelling the
Recurring Subscription
You may cancel a direct France Channel subscription at any time by
signing in at www.francechannel.tv, opening Account Details or Settings
and selecting the subscription cancellation option. The online
cancellation path is intended to provide a simple and direct way to stop
future automatic renewals. We will not require you to explain why you
are cancelling.
If you cannot access the online cancellation function, email support.uk@francechannel.tv
from the email address registered to the account. We may ask you to
authenticate the account before processing the request. If you
subscribed through a third-party platform, you may need to cancel
through that platform's account or subscription settings.
Cancellation stops future automatic renewals when it is processed.
Unless applicable law or the subscription offer provides otherwise,
cancellation takes effect at the end of the current paid billing period
or free trial, and you may continue to access the Services until then.
You must cancel before the next charge is processed to avoid that
charge. We will provide a cancellation confirmation by email or through
the applicable platform.
11. Free Trial, First
Charge and Renewal Dates
A seven-day free trial is available only where expressly offered at
checkout and may be limited to new subscribers or one trial per person,
household, payment method or account. The checkout will state when the
trial begins and when the first paid term begins.
Unless the checkout states otherwise or applicable law requires a
notice, France Channel does not promise a separate email immediately
before the seven-day free trial ends or before the first charge. The
first charge date will be shown before purchase and in the subscription
confirmation.
A monthly plan renews for successive monthly periods and an annual
plan renews for successive annual periods until cancelled. Your Account
Details will display your subscription status and, where supported, the
current price and next billing date.
12.
Annual Renewal Reminder and Other Subscription Notices
For an annual subscription billed directly by France Channel, France
Channel will send an email reminder 30 days before the scheduled
automatic-renewal payment. The reminder will identify the subscription,
renewal date, renewal price, the fact that it will renew automatically
unless cancelled, and the method for cancelling before the charge.
We do not generally send a separate email before every unchanged
monthly recurring charge. This does not limit any obligation to send a
trial, annual-renewal, price-change, cancellation or other notice
required by applicable law.
Where a third-party platform controls annual billing, its
renewal-notice rules and processes apply. France Channel will send its
own reminder only where it has the information and contractual ability
required to do so.
A notice is treated as sent when transmitted to the current email
address registered to the account. Failure to open or read a properly
sent notice does not by itself stop a scheduled renewal, but it does not
remove any non-waivable legal right.
13. Price and Material Term
Changes
France Channel may change subscription prices or other plan terms
prospectively. For an existing direct recurring subscription, we will
provide at least 30 days' advance notice by email of a price increase or
other material change, unless a shorter period is required for a legal,
regulatory, security or tax reason and is permitted by law.
The notice will state the new price or material term, the effective
date and how to cancel before the change applies. If you do not wish to
continue at the new price or on the changed terms, cancel before the
next subscription period begins. We will obtain additional consent where
applicable law requires it.
14. Refunds, Credits and
UK Consumer Rights
Except where required by applicable law, promised in the subscription
offer or stated in these Terms, payments are non-refundable and France
Channel does not provide credits for partially used billing periods.
Following ordinary cancellation, access generally continues until the
end of the paid period.
Nothing in these Terms affects your mandatory rights under UK
consumer law. Digital content must be of satisfactory quality, fit for a
particular purpose made known to us and as described. Depending on the
circumstances, you may be entitled to a repair, replacement, price
reduction, refund or compensation where the Services do not meet legal
requirements.
Questions about a charge, refund or statutory remedy must be sent to
support.uk@francechannel.tv.
Chargeback and payment-network rights are not limited by these
Terms.
By creating an account or purchasing a subscription, you agree to
receive electronic communications concerning the account and Services,
including purchase confirmations, service messages, security messages,
payment notices, annual-renewal reminders, price-change notices,
cancellation confirmations and other transactional or legally required
communications.
France Channel will provide notices under these Terms by email,
unless a third-party platform controls the subscription and uses its own
permitted notice method. You are responsible for keeping your registered
email address current.
France Channel may send optional promotional emails about France
Channel Content or Services where permitted by law and consistent with
your choices. You can unsubscribe from promotional emails at any time.
You cannot opt out of transactional, account-security, billing, renewal,
cancellation or legally required messages while they remain necessary to
administer the account or subscription.
16. Intellectual
Property and Permitted Use
France Channel, its affiliates and its licensors own or control the
Services and Content, including video, audio, text, graphics,
photographs, designs, software, trademarks, trade names, logos and other
materials. Subject to these Terms, we grant you a limited,
non-exclusive, non-transferable and revocable licence to access and view
Content for personal, non-commercial use during an active subscription
or other authorised access period.

Do not copy, download except where the Services expressly permit
it, reproduce, republish, upload, transmit, distribute, sell, rent,
license, publicly display or perform, edit, store, adapt or create
derivative works from the Services or Content.

Do not circumvent or remove digital-rights management,
geo-blocking, access controls, content protection or other technical
restrictions.

Do not reverse engineer, decompile, disassemble or modify
software, or use automated tools to scrape or systematically extract
Content or Service data, except to the extent applicable law prevents us
from restricting that activity.

Do not interfere with the operation, security, availability or
integrity of the Services, introduce malicious code, manipulate
identifiers, impersonate another person or use the Services for
unlawful, abusive or fraudulent activity.

Do not use France Channel names, marks, logos or Content in a
manner that suggests sponsorship, endorsement or affiliation without
prior written permission.
No licence or right is granted except as expressly stated in these
Terms. France Channel and its licensors reserve all rights not expressly
granted.
17.
Account Sharing, Devices and Geographic Restrictions
A subscription is for personal, non-commercial use unless the
applicable plan expressly states otherwise. You may not share the
account outside your household or otherwise make the subscription
available to unauthorised persons. France Channel may limit the number
of registered devices and simultaneous streams, and those limits may
vary by plan or platform.
You may not bypass subscription, registration, geo-fencing or other
access requirements, or assist another person to do so. Access from
outside the United Kingdom may be blocked to comply with content
licences and distribution rights.
18. Software and Updates
France Channel may provide software or application updates
automatically. If you decline or fail to install an update, some
Services may not function. You are responsible for device compatibility,
a supported operating environment and an active internet connection.
Software may collect limited device and Service-use information
needed to authenticate access, manage Content rights, provide playback,
diagnose problems, enforce these Terms and improve the Services, as
described in the UK Privacy Policy. When your right to use the software
ends, you must stop using it and delete copies where applicable.
19. Feedback,
User Submissions and Unsolicited Ideas
If France Channel makes a feedback, comment or other submission
feature available, you are responsible for material submitted through
your account and must have the rights needed to submit it. Do not submit
unlawful, harmful, threatening, abusive, harassing, defamatory, obscene,
hateful, infringing, deceptive, commercial-solicitation or malicious
material.
You grant France Channel a non-exclusive, worldwide, royalty-free
licence to host, reproduce, display, modify and distribute material you
submit only as reasonably necessary to operate, secure, moderate,
promote or improve the relevant feature, subject to applicable law and
the UK Privacy Policy. France Channel may remove or restrict material or
access where reasonably necessary.
France Channel does not accept unsolicited creative submissions,
including programme concepts, stories, scripts, character ideas or
designs. Please do not send them. If you nevertheless submit unsolicited
material, it will not be treated as confidential and France Channel will
have no obligation to review, return or compensate you for it, to the
extent permitted by law.
The Services may contain links to or integrations with third-party
websites, platforms, payment services, app stores, social networks or
other services. Their terms and privacy practices apply to their
services. A link or integration does not constitute an endorsement, and
France Channel is not responsible for third-party content, practices,
availability or transactions except as required by law.
If you acquire a France Channel application or subscription through
an app marketplace or other third party, the agreement concerning France
Channel Content and use of the Services is between you and France
Channels SAS, but the platform may control payment, trial, renewal,
cancellation and refunds. The marketplace and its affiliates may be
third-party beneficiaries of these Terms to the extent required by its
rules.
21. Changes to the
Services and These Terms
France Channel may update the Services, Content, features and these
Terms from time to time. Changes will take effect when posted or on a
later date stated in a notice. If a change materially affects your legal
rights or obligations, we will provide advance notice and obtain consent
where required by applicable law.
We will aim to provide at least 30 days' notice of a material change
unless a security, legal or regulatory reason requires a shorter period.
Nothing in this section permits a change to an existing paid
subscription price or another material subscription term without any
notice or consent required by law. If you do not agree to revised Terms,
you may cancel before the change takes effect.
22. Suspension and
Termination
France Channel may suspend or terminate access where reasonably
necessary to protect the Services or Content, prevent fraud or
unauthorised use, address non-payment, comply with law, enforce these
Terms or protect France Channel, its licensors, users or third parties.
Where required by law, we will provide applicable notice, continued
access, refund or another remedy.
On termination, your licence to use the affected Services and Content
ends. Provisions that by their nature should survive termination,
including provisions concerning ownership, use restrictions, liability,
dispute resolution and accrued payment obligations, will survive.
You are responsible for foreseeable losses France Channel suffers as
a direct result of your deliberate, unlawful or materially unauthorised
use of the Services, but only to the extent permitted by consumer law.
This does not create liability for ordinary household use or accidental
minor breaches.
23. Our Responsibility to You
France Channel will provide the Services with reasonable care and
skill. The Services and Content are made available subject to licensing,
technical and operational limitations, and France Channel does not
promise uninterrupted or error-free operation, a particular streaming
quality or the continued availability of a particular item of
Content.
France Channel is responsible for losses you suffer that are a
foreseeable result of our breach of these Terms or failure to use
reasonable care and skill. A loss is foreseeable if it was obvious that
it would happen or if, when the contract was made, both you and France
Channel knew it might happen.
France Channel is not responsible for loss that is not foreseeable,
for business losses where you use the Services for commercial purposes,
or for failures caused by your internet service, device, software,
payment provider or another matter outside our reasonable control. We
will take reasonable steps to minimise the effect of an event outside
our control and restore the Services where practicable.
If defective digital content supplied by France Channel damages a
device or other digital content belonging to you and this is caused by
our failure to use reasonable care and skill, we will repair the damage
or pay compensation as required by law.
Nothing in these Terms excludes or limits liability for death or
personal injury caused by negligence, fraud or fraudulent
misrepresentation, breach of statutory rights, or any other liability
that cannot lawfully be excluded or limited.
24. Subtitles and
Accessibility Support
Subtitles, closed captions, audio description and other access
services may vary by Content, device and platform. Questions or
complaints about subtitles or accessibility support may be sent to support.uk@francechannel.tv.
Please include the programme title, device or platform, date and
approximate time of the issue and a description of the problem.
25. Governing Law and Disputes
These Terms are governed by the laws of the French Republic, without
regard to conflict-of-law principles. However, if you are a consumer
habitually resident in the United Kingdom, you also benefit from any
mandatory consumer protections of the law of the part of the United
Kingdom in which you live that cannot be displaced by a choice of French
law.
Before starting formal proceedings, you and France Channel should
attempt in good faith to resolve the matter by emailing support.uk@francechannel.tv.
You may bring proceedings in the courts that have jurisdiction under
applicable law, including the courts of the part of the United Kingdom
in which you live where consumer law permits. Nothing in these Terms
requires a UK consumer to bring a claim exclusively in France.
These Terms are available in English. Nothing prevents France Channel
from seeking urgent injunctive or other equitable relief to protect
intellectual-property rights, Content rights, security or unauthorised
access.
26. Sanctions and Legal
Compliance
You must comply with applicable export-control, trade-sanctions and
similar laws when accessing or using the Services, software or related
technical data. You may not use or make the Services available in a
manner prohibited by applicable law.

France Channel does not provide a telephone, postal or in-person
customer-contact channel for the Services. The address of France
Channels SAS at 8 Avenue Raphaël, 75016 Paris, France identifies the
company but is not the contact method for requests under these Terms. If
you subscribed directly online, you can also cancel through Account
Details or Settings without contacting customer service.
28. Entire
Agreement, Severability and Waiver
These Terms, the UK Privacy Policy and any subscription-specific
terms presented at checkout form the agreement between you and France
Channel concerning the Services. If there is a conflict, the
subscription-specific information presented at checkout controls only
for the plan, price, free-trial, billing and renewal terms expressly
stated there.
If a provision is held invalid or unenforceable, it will be modified
or severed only to the extent necessary, and the remaining provisions
will remain in effect. A failure to enforce a provision is not a waiver
of that provision or any other provision. Except where these Terms
expressly provide otherwise, there are no third-party beneficiaries
other than an applicable app marketplace to the extent stated in Section
20.
29. Important Subscription
Summary
Complete and email this form only if you wish to exercise the
statutory 14-day cancellation right. A clear email statement containing
the same information is sufficient.
